Website Terms of Use

These terms cover your use of the Macabre website (the "Site"), run by WEFORGE STUDIO PTY LTD ("we", "us" or "our"). By using the Site you agree to them. If you do not agree, please do not use the Site.
Playing the game is covered by our End User License Agreement (EULA), not by these terms. How we handle personal information is covered by our Privacy Policy. Nothing in these terms takes away rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law.
1. Using the Site
You may use the Site for lawful, personal purposes. You may not:
- try to get into parts of the Site or its systems that are not meant for you, such as the admin area, or probe, overload or interfere with them;
- use bots, scripts or other automated tools on the Site's forms, or submit false or misleading details;
- sign up an email address that is not yours to the newsletter; or
- use the Site to send us anything unlawful, abusive, threatening or infringing.
2. Key claim
The key claim page is for Kickstarter backers to look up the keys allocated to them. Use only your own details. You may not try to guess or work out other people's details or keys.
We limit repeated failed attempts, and we may block access or refuse a claim where we reasonably believe someone is misusing the page. Keys are redeemed on Steam, so Steam's terms and our EULA apply to them, and your Kickstarter rewards are as described in the campaign. If something looks wrong with your record, contact us and we will sort it out.
3. Newsletter
When you sign up we email you a confirmation link, and you join the list only when you click it. You can unsubscribe at any time using the link in our emails, or by sending us a message through the contact form. We use your address only to send you news about Macabre and we do not give it to other companies for their own marketing. The Privacy Policy has the details.
4. Contact form and feedback
We read the messages we receive but we cannot promise to reply to every one. Any feedback, suggestions or ideas about Macabre that you send us are "Feedback" under section 7 of the EULA.
5. Our content
The Site, the game, and everything in them, including the Macabre name, logos, artwork, screenshots and text, are owned by or licensed to WEFORGE STUDIO PTY LTD and protected by intellectual property laws. You may not copy or reuse them except as the law allows or as section 4.2 of the EULA allows for streaming, videos and screenshots of the game. You may not use our trademarks or logos without our written consent, except to identify the game in content that the EULA allows.
6. Links to other sites
The Site links to services we do not run, such as Steam, Discord, Kickstarter and Pledgebox. They have their own terms and privacy policies, and we are not responsible for their content or practices.
7. The Site as it is
We try to keep the Site accurate and available, but it may change, be unavailable or be taken down, and some parts, such as the key claim page, will not be needed forever. Except for the guarantees and rights that the law does not let us exclude, and to the maximum extent permitted by law, the Site is provided "as is" and "as available".
8. Limitation of liability
To the maximum extent permitted by law, WEFORGE STUDIO PTY LTD is not liable for any incidental, consequential, indirect, special or punitive loss arising out of your use of the Site. Where the Australian Consumer Law allows our liability for failing to meet a consumer guarantee to be limited, it is limited to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including for fraud or for death or personal injury caused by negligence.
9. Governing law and disputes
These terms shall be governed by and construed in accordance with the laws of New South Wales (NSW), Australia, without regard to its conflict of law principles. If you are a consumer living outside Australia, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.
If there is a dispute between you and us, you agree to first contact us through the contact form at macabregame.com/contact and make a good faith effort to resolve it before resorting to more formal means, such as court action. This does not stop you from contacting a consumer or data protection authority at any time.
10. Changes to these terms
We may update these terms as the Site changes. When we do, we will change the date at the top. If you keep using the Site after that, you accept the updated terms.
